SERVICE CONCIERGE, is a French Company, registered in Paris with number 485 281 232, and whose offices are located at 120 Avenue des Champs Elysées – 75008 PARIS. SERVICE CONCIERGE acts as an intermediary between its Members and Suppliers, or Service Providers.
I. Introduction:
1.1 These Terms and Conditions are provided to each new member upon joining.

Members are assumed to have read and understood these Terms and Conditions. Unless otherwise specifically stated, these Terms and Conditions shall prevail over any other material or documents distributed by SERVICE CONCIERGE (brochures, newsletters, catalogues etc.).

1.2 If any of the provisions of this document are found to be null and void, it will not imply invalidity of the Terms and Conditions as a whole, and all other provisions shall remain in effect.

Any provision that is disputed by a Member will not be accepted by SERVICE CONCIERGE without prior written acceptance, regardless of when it was brought to SERVICE CONCIERGE’s attention.

1.3 The Member is free to enter into a contractual agreement with SERVICE CONCIERGE and to accept the present Terms and Conditions.

The Member shall agree to the Terms and Conditions of each Supplier and Service Provider with whom he is put in contact at the time of purchase.


II. Membership:
2.1 This subscription to Private Concierge Services provided by SERVICE CONCIERGE is strictly for personal use.

Each member is responsible for his/her Membership and must ensure that no one other than himself/herself uses the Membership. Benefits of the Membership for professional purposes are not acceptable (i.e. a Member shall not use his Membership to provide services for any 3rd party). Such services can be provided within the framework of a specific corporate agreement.

The benefit of any request submitted to SERVICE CONCIERGE is reserved to the Member only, and cannot be transferred to any 3rd party without the prior consent of SERVICE CONCIERGE and, depending on the circumstances, of the Service Provider.

Telephone calls made to SERVICE CONCIERGE may be recorded for training and quality purposes.

2.2 All Memberships are subject to verification by SERVICE CONCIERGE.

SERVICE CONCIERGE will generally notify you that your Membership application has been accepted within 2 working days.

Each Member must provide SERVICE CONCIERGE with accurate information when applying for Membership. Any missing information may result in your Membership application being delayed or refused. SERVICE CONCIERGE will not be held responsible for any consequences arising from inaccurate or misleading information provided by the Member.

It is the responsibility of the Member to notify SERVICE CONCIERGE as soon as possible should any changes to the Member’s personal information arise.

2.3 Two types of offers are available. Each offer provides a different level of service:
    a) a) Subscription to the “JP5” service gives the Member unlimited access to the private concierge services provided by SERVICE CONCIERGE for the duration of one (1) year. The service is available from Monday to Friday, from 8am to 8pm, except on Bank Holidays.
    Subscription to the “JP 5” service is for a minimum 12 month Membership Term commitment and is priced at 100 € / Month (inc. sales tax).

    If a Member wishes to subscribe with his spouse, a specific “Couple” offer is available and priced at 170 € / Month (inc. sales tax). This subscription is also for a minimum of a one (1) year period.
    b) b) Subscription to the “JP7” service gives the Member unlimited access to the private concierge services provided by SERVICE CONCIERGE, 365 days per year.
    Subscription to the “JP 7” offer is for a minimum 12 month Membership Term commitment and is priced at 150 € / Month (inc. sales tax).

    If a Member wishes to subscribe with his spouse, a specific “Couple” offer is available and priced at 250 € / Month (inc. sales tax). This subscription is also for a minimum of a one (1) year period.
2.4 Subject to article L121-20 of French Consumer Laws, and where a Member has not already taken advantage of the Services provided by SERVICE CONCIERGE, the Member has the right to a cooling-off period of seven (7) working days to withdraw consent and cancel the Membership. Notice of cancellation must reach SERVICE CONCIERGE within the seven day period immediately following acceptance of the Membership by SERVICE CONCIERGE.

The cancellation will be an action free of any charges and the member is not required to provide any reason for cancellation.

Upon cancellation, the Member will receive a full refund of the amounts already paid, and will be required to return all material and documentation (gift box, brochures, etc.) received from SERVICE CONCIERGE previously.

2.5 During the period of the first month, Members have the right to terminate this agreement and cancel their subscription to the services provided by SERVICE CONCIERGE. The Member should simply give notice to SERVICE CONCIERGE by registered post at the latest 5 days prior to the end of the first month period.

In this event, the cancellation of your Membership is free of charge and you will not be required to provide any reason.

2.6 SERVICE CONCIERGE reserves the absolute right to cancel or suspend Membership (at its sole discretion) without notification in case of: abusive or fraudulent activity; prejudicial behavior regarding the interests of SERVICE CONCIERGE; falsification of information provided either to SERVICE CONCIERGE, or to Suppliers by the Member, or a 3rd party acting on the Member’s behalf.

In this case, SERVICE CONCIERGE reserves the right to reimburse the Member or not, for the amount in pro rata temporis equal to his unused Membership or, if applicable, to suspend debits. No claims for any form of refund or compensation will be accepted.

2.7 SERVICE CONCIERGE reserves the right to review its prices at any time.

The Membership Term will renew automatically for the period of one year, effective the first day following the conclusion of the existing Membership Term.

The Member will be notified about renewal conditions two (2) months prior to the Membership expiry date by email or post.
The Member will have one (1) month to act upon this notification. To cancel the renewal of the Membership we require that notice is served to SERVICE CONCIERGE in writing and by registered post.

If no cancellation notice is served by the Member within the one (1) month period, the Membership Term will renew automatically for a period of one (1) further year in accordance with these Terms and Conditions. SERVICE CONCIERGE reserves the right to charge the Members account and process payment for the full amount of the new Membership fees.

2.8 In case of non-payment of Membership fees by the Member at the due dates, SERVICE CONCIERGE is fully authorised to send the Member legal notice to demand payment within 8 days.

If, after this time, Membership fees have not been received, SERVICE CONCIERGE has the right to cancel the Membership, and shall not be held liable for any refund or compensation requested by the member.

If, after according a further 10-day period to the Member, fees have not been settled, access to the services shall be suspended and all outstanding fees shall be paid in full. SERVICE CONCIERGE reserves the right to take legal action against the Member to ensure payment.

2.9 In the event of non-usage of the services provided by SERVICE CONCIERGE the Member shall not be entitled to any form of discount or refund.


III. Services :
3.1 Once the service has been activated, the Member can submit requests by email, by telephone, or through website(s), or mobile application(s).

SERVICE CONCIERGE will process requests made by the Member and will act as an intermediary between the Member and selected Suppliers and Service Providers.

3.2 Requests submitted to SERVICE CONCIERGE by Members should respect at all times the requirements of the law and code of ethics. In the event that this is not the case SERVICE CONCIERGE reserves the right to refuse the Member’s request.

In certain countries, access to some of the products or services provided by SERVICE CONCIERGE may be restricted. No goods or services will be provided by SERVICE CONCIERGE to a Member should they not comply with the applicable laws in the country where the service or product is being delivered.

3.3 SERVICE CONCIERGE will require a written confirmation from the Member in order to act on any request for service provision or billing above the amount of 100 €, and to this effect. Hence, the Member accepts that all electronic documents (email, SMS, recordings, etc.) constitute a confirmation to proceed with the transaction.

3.4 All orders made by the Member are subject to availability by the Service Provider or Supplier.

In the event that a requested product or service becomes unavailable, SERVICE CONCIERGE will do the utmost to provide the Member with an alternative option of a similar description and/or standard.

Should the Member decide not to accept this proposition, SERVICE CONCIERGE will simply cancel the request.

No compensation whatsoever can be claimed by the Member in this event.

3.5 SERVICE CONCIERGE will liaise with the Supplier on behalf of the Member. The Member can also contact the Supplier directly if necessary or requested expressly by the Member.

3.6 Members will benefit from a number of advantages and negotiated offers provided by the Supplier and Service Providers, selected on their behalf by SERVICE CONCIERGE.

Suppliers and Service Providers are free to modify their Terms and Conditions of sale at any time. Therefore, SERVICE CONCIERGE will not be held responsible for any of these changes.


IV. Payment:
4.1 Products and services will be billed to the Member according to the specified rates given by the selected Service Providers or Suppliers.

Members may give consent to SERVICE CONCIERGE to use their Credit Card information to pay for products or services directly to the Supplier or Service Provider.

4.2 Validation by a Member of a proposal sent by email by SERVICE CONCIERGE will be considered as an acceptance of the transaction and the Member’s credit card will be charged for the order amount.

The Member must ensure that the credit card details provided are correct and accurate and make sure sufficient funds are available in the bank account to cover all requested purchases.

4.3 As soon as an order is validated by the Member, payment must be immediately made. In case of payment delay, SERVICE CONCIERGE shall not be liable for changes in prices and/or availability of the order products and/or services.

4.4 In case of payment delay, penalties may be applied either by SERVICE CONCIERGE (at a rate of 10%) or by the relevant Supplier based on its specific Terms and Conditions.

4.5 Certain types of services can generate extra and additional costs.

The Member hereby gives SERVICE CONCIERGE the authorisation to charge the amount of these costs to the Member’s credit card account. Under no circumstances will SERVICE CONCIERGE make an advance payment on behalf of its Members. Payment of products and services will be made in accordance with the general Terms and Conditions of the Supplier or Service Provider at the time of purchase.

V. Personal Services:
-Shopping: At the Members request, SERVICE CONCIERGE can make purchases in the name of the Member. An hourly fee of 60 Euros will be billed to the Member (on receipt of prior agreement by the Member) for each hour spent shopping by a concierge (each extra hour entered into is due in full).

-Travel: SERVICE CONCIERGE holds a registered certificate, and is a certified Travel Operator under the registration number: IM075100290. Full Terms and Conditions for travel are available at www.serviceconcierge.com/TC_travel.php

-Restaurants and Clubs: For certain restaurant and club reservations, credit card details are requested to secure the booking. In this event, the Member authorises SERVICE CONCIERGE to use credit card details to this effect.

-Tickets: SERVICE CONCIERGE commits to doing all in its power to contact specialised Suppliers in order to find and obtain the best possible tickets to all events on the behalf of its Members. Should an event be sold out, SERVICE CONCIERGE may use specific Suppliers. Consequently, ticket prices may vary at any time and be different from the face value because of agency, processing and/or administrative fees. Every sale is final, no refunds or cancellation will be issued after the purchase of the ticket. Members must check event schedules, as organisers or producers may change event date and time without prior notice. SERVICE CONCIERGE cannot be held responsible for the loss of tickets, or for delivery problems, or if the event is cancelled or postponed. In the case of cancellation or postponing by the artist, producer, or organiser, SERVICE CONCIERGE may only refund the ticket’s face value.


VI. Commitment:
6.1 SERVICE CONCIERGE is committed to satisfying all requests made by the Member in the shortest space of time possible, and to provide advice in relation to these requests.

6.2 SERVICE CONCIERGE acts as an intermediary between the Member and the Supplier, or Service Provider.

6.3 SERVICE CONCIERGE shall provide the necessary means to satisfy requests to the fullest extent possible.


VII. Liability:
7.1 The Member agrees that SERVICE CONCIERGE acts in accordance with the requests and requirements of the Member.

SERVICE CONCIERGE shall not be held responsible for any errors due to information of a misleading or inaccurate nature given by the Member.

SERVICE CONCIERGE shall not be held responsible for the recommendation and choice of Suppliers, and is authorised to refuse or cancel any order in the event of an existing dispute with the Member.

7.2 SERVICE CONCIERGE will not be held responsible for any delays or failures to carry out its obligations in the event of unforeseen circumstances – an “act of god” (strikes, power cuts, fire, floods etc.).

7.3 Suppliers and Service Providers take full responsibility for the services, benefits, and products they provide.

7.4 In the event of a dispute, SERVICE CONCIERGE’s liability is limited to the amount of the Membership subscription fees.


VIII. Privacy and Confidentiality:
8.1 SERVICE CONCIERGE is committed to respecting the trust that the Member places with it.

In accordance with this ethical code, SERVICE CONCIERGE will protect all personal information provided by Members during subscription to the Membership and service.

The usage of this personal information is strictly reserved for internal purposes (request management, order and delivery organisation, billing, etc. – and also internal market studies, and personalised promotional material).

According to applicable legal regulations and obligations regarding privacy and personal data, SERVICE CONCIERGE collects and stores this information according to legal standards, and holds the declaration number 1259523.

This information is accessible only by SERVICE CONCIERGE employees, and subsidiary companies, and used only in Members interests.

According to Article 27 of the French law n°78-17 of January 6, 1978 ("Loi Informatique et Liberté"), relative to privacy and personal data protection, Members are entitled to access, modify, or withdraw their own information recorded with SERVICE CONCIERGE, according to the article 34 of the same law.

8.2 “Cookies” may be stored on the user’s computer whenever he browses our website www.johnpaul.com. Our cookies keep track of the visits on our website (frequency, time and date…).


IX. Libel:
According to the Law of July 29, 1881, SERVICE CONCIERGERIE SAS reserves the right to take legal action against anyone who perpetrates slander or libel against it. Any allegation or imputation of an act damaging SERVICE CONCIERGE’s honor or consideration, directly or by means of copy, may be prosecuted.


X. Copyright and Trade mark SERVICE CONCIERGE:
10.1 The brand name “John Paul” is a registered trademark, and all rights are exclusively reserved to SERVICE CONCIERGE.

You may not otherwise use, reproduce, download, store, post, broadcast, transmit, modify, sell, or license any information or content obtained from the website (http://www.johnpaul.com), or documents, without the prior written approval of SERVICE CONCIERGE in accordance with intellectual property laws.

10.2 The SERVICE CONCIERGE website and documents are strictly for the personal use of the Member, and may not be used for commercial purposes.


XI. Applicable Law and juridiction
11.1 These Terms and Conditions of sale and your Registration to the service with SERVICE CONCIERGE are governed by the laws of France, and are subject to the exclusive jurisdiction of the courts of France.

11.2 If the Member does not abide by the present Terms and Conditions, his civic and/or penal liabilities may be engaged.

11.3 If any dispute should arise, the Member agrees to participate in good faith, and in an amicable conciliation phase with SERVICE CONCIERGE prior to any judicial proceedings.

Any dispute regarding the present Terms and Conditions which is not settled by direct mediation will be submitted to the courts of France.
